Terms of sale

1. Parties to the contract

These general terms of sale govern the contractual relationship between:

  • Seller: Dartel Solutions, owner Rodion Tulba (sole trader), Tax ID (NIF) X6932159M, with address at C/ Azahar 3, portal 6, 3D, 29730 Rincón de la Victoria, Málaga, Spain. Email: info@dartelsolutions.com. Phone: +34 612 49 49 00.
  • Customer: any natural or legal person who places an order for products or contracts a service through dartelsolutions.com or shop.dartelsolutions.com, or through any direct contact channel (email, phone, WhatsApp).

These terms are drafted in compliance with Spanish Royal Legislative Decree 1/2007 (Consolidated Text of the General Law for the Defence of Consumers and Users, TRLGDCU), Law 7/1996 on Retail Trade and the LSSI-CE.

2. Scope and subject matter

These terms apply to:

  • The sale of electronic security products (cameras, recorders, alarms, video intercoms), WiFi networking and accessories through the online store.
  • The contracting of services for installation, maintenance, technology consulting and telecommunications, through the website or any contact channel.

Dartel Solutions provides its services mainly in Málaga and the Costa del Sol (Spain).

3. Online ordering process

The purchase process in the online store works as follows:

  1. The customer selects the products and adds them to the cart.
  2. They complete the shipping, billing and payment details.
  3. They review the order summary (products, quantities, prices including VAT and shipping costs) before confirming.
  4. They confirm the order by pressing the purchase button and complete the payment.
  5. Dartel Solutions sends a confirmation email to the address provided. The contract is concluded at the moment the customer receives that confirmation email.

Dartel Solutions reserves the right to refuse or cancel an order in the following cases: product out of stock, an obvious error in the published price, invalid payment details, or signs of fraud. In the event of cancellation, the amount paid will be refunded in full.

4. Service quotes

Quotes for installation, maintenance or other services sent by email or WhatsApp are valid for 30 calendar days from their date of issue, unless the quote expressly states a different period. Written acceptance of the quote (email or message) formalises the service contract.

5. Prices

The prices published in the store include the applicable VAT (21%), unless expressly stated otherwise. Shipping costs are shown itemised in the checkout process before confirming the order and are borne by the customer, except for special promotions indicated on the product page or in specific communications.

Dartel Solutions reserves the right to change prices at any time. The applicable price is the one in force at the time the order is confirmed by the confirmation email. Obvious typographical pricing errors do not oblige Dartel Solutions to sell at the erroneous price.

Note: The prices shown in the store are valid only for customers with a delivery address in mainland Spain and the Balearic Islands. For the time being we do not ship to the Canary Islands, Ceuta or Melilla.

6. Payment methods

The store currently accepts the following payment methods:

  • Debit or credit card: payment through the secure gateway of Stripe Payments Europe, Ltd. (it also supports wallets such as Apple Pay and Google Pay). The transaction takes place in an encrypted environment (TLS/SSL) and Dartel Solutions does not store card details.

For installation services, payment may be agreed with a partial advance upon confirming the quote and the remainder upon completion of the work, as specified in the quote.

7. Product availability

The availability of each product is indicated on its product page. If a product is out of stock after the order has been confirmed, Dartel Solutions will inform the customer within a maximum of 48 working hours, offering the following alternatives: an equivalent product, waiting until stock is replenished, or a full refund.

8. Shipping and delivery of products

Estimated delivery times for mainland Spain are 2 to 7 working days from payment confirmation, unless otherwise indicated on the product page. These times are indicative and may be affected by external circumstances (strikes, public holidays, extraordinary situations).

Dartel Solutions is not responsible for delays attributable to the transport company once the parcel has been handed over to the carrier, although it will do everything possible to resolve the incident.

The risk of loss or deterioration of the product passes to the customer at the moment of physical delivery. If the packaging shows visible damage upon receipt, note it on the carrier’s delivery note and contact info@dartelsolutions.com immediately.

9. Legal guarantee of conformity

All products sold in the store come with the 3-year legal guarantee of conformity from the date of delivery, in accordance with Article 118 et seq. of the TRLGDCU (as amended by Royal Decree-Law 7/2021 transposing EU Directive 2019/771).

In the event of a lack of conformity arising during the first 12 months after delivery, the defect is presumed to have existed at the time of delivery. The customer has the right to choose between repair or replacement of the product; if neither is possible or proportionate, they may request a price reduction or termination of the contract with a full refund.

To make a claim under the guarantee, contact info@dartelsolutions.com indicating the order number, a description of the problem and photographs if the defect is visible.

This legal guarantee is independent of and compatible with any additional commercial warranty offered by the product manufacturer.

10. Right of withdrawal

Consumer customers have the right to withdraw from the contract within 14 calendar days of receiving the product or, in the case of services, of signing the contract, without giving any reason and without any penalty, in accordance with Article 102 of the TRLGDCU.

The right of withdrawal does not apply to:

  • Products manufactured or configured to the customer’s specifications.
  • Products that may deteriorate or expire quickly.
  • Sealed products not suitable for return for health or hygiene reasons, which have been unsealed after delivery.
  • Installation services already performed in full, with the customer’s express consent before the start of the work.

11. Liability and limitations

Dartel Solutions shall not be liable for indirect or consequential damages arising from the use or inability to use the products purchased, except in those cases where Spanish law does not allow liability to be limited (liability for defective products, wilful misconduct or gross negligence).

12. Dispute resolution and complaints

For any complaint, the customer may contact info@dartelsolutions.com or call +34 612 49 49 00. Dartel Solutions undertakes to acknowledge receipt within 48 hours and to provide a reasoned reply within a maximum of 10 working days.

In accordance with Regulation (EU) 524/2013 on online dispute resolution for consumer disputes, EU consumers may use the European Commission’s Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.

Without prejudice to the above, the customer may file complaints with the Consumer Arbitration Boards or the Municipal Consumer Information Offices (OMIC) of Málaga.

These terms are governed by Spanish law. For disputes that cannot be resolved out of court, the parties submit to the Courts and Tribunals of Málaga, expressly waiving any other jurisdiction.
